Please read these Terms and Conditions ("Terms") carefully before using the Vilayash Enterprises online store (operated on the HDFC Vyaparify platform) and placing any orders. By placing an order, you agree to be bound by these Terms.
These Terms govern the offer and sale of cemented paver blocks (the "Products") by Vilayash Enterprises ("Seller," "we," "us") to the customer ("Buyer," "you").
Your online transaction with us is a staged process and does not constitute a confirmed contract upon initial checkout.
Order Creation: When you submit an order online, this constitutes an offer to purchase. You will receive an initial message (SMS/Email) confirming the creation of this order.
Order Acceptance and Payment Link: We will review your offer. If we accept the order (based on stock availability, delivery feasibility, and pricing), you will receive a subsequent message (SMS/Email) confirming Order Acceptance and containing a Payment Link.
Contract Formation (Successful Order Placement): The contract of sale is only finalized and the order is considered "Successfully Placed" when:
We have sent the Order Acceptance message.
You have successfully completed the payment via the provided Payment Link.
Refusal of Order: We reserve the right to refuse or cancel any order at any stage prior to final Order Placement for reasons including, but not limited to, product unavailability, errors in the product or price, or inability to process the payment.
Vilayash Enterprises offers more than 500 types of cemented paver blocks.
Product Nature: Due to the nature of cement, manufacturing processes, and natural raw materials, the final delivered Products may have minor variations in color, shade, texture, and efflorescence (white patches) compared to digital images or samples. Such minor variations are not considered defects and do not qualify for returns or refunds.
Measurement: All sizes and specifications listed are approximate. You are responsible for ensuring the quantity and specifications are suitable for your intended purpose.
Pricing: All prices are subject to change without prior notice. The price confirmed in the Order Acceptance message will be the final price for that transaction.
Payment: All payments must be made online via the Payment Link provided by us. We are not responsible for any payment issues arising from the use of third-party payment gateways linked via the HDFC Vyaparify platform.
In no event shall Vilayash Enterprises be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Products, including but not limited to lost profits, cost of installation, or property damage. Our total liability for any claim shall not exceed the total amount paid by the Buyer for the specific Products that are the subject of the claim.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Uttar Pradesh, India.
